leading expert consultant of the Department of Additional Budgetary institutions, when developing a remuneration system, are guided primarily by the Labor Code of the Russian Federation, as well as legislative acts that regulate the procedure for establishing a remuneration system at the federal, regional, municipal levels and sectoral federal, regional, municipal acts. However, although budgetary institutions use generally accepted standards when establishing a wage system, the formation and establishment of a wage fund in budgetary institutions differs significantly from the generally accepted one.
Recommendations for remuneration of employees of state and municipal institutions
Federal budgetary (state) institutions are obliged to use federal laws (other regulatory legal acts) when establishing wages. Currently in force is Decree of the Government of the Russian Federation dated 05.08.2008 No. 583 “On the introduction of new systems of remuneration for employees of federal budgetary and government institutions and federal state bodies, as well as civilian personnel of military units, institutions and divisions of federal executive authorities, in which the law provides military and equivalent service, the remuneration of which is currently carried out on the basis of the Unified tariff schedule for remuneration of employees of federal government institutions" (together with the Regulations on the establishment of remuneration systems for employees of federal budgetary and government institutions (hereinafter referred to as the Regulations). In addition, , institutions at any level must take into account the Unified Recommendations for the establishment at the federal, regional and local levels of remuneration systems for employees of organizations financed from the relevant budgets.The decision of the Russian Tripartite Commission for the Regulation of Social and Labor Relations dated December 27, 2011, Protocol No. 10, approved the Unified Recommendations on the establishment at the federal, regional and local levels of remuneration systems for employees of state and municipal institutions for 2012 (hereinafter referred to as the Recommendations). Recommendations for 2012 are supplemented by the principle of ensuring that the salary of each employee depends on his qualifications, the complexity of the work performed, the quantity and quality of labor expended, without limiting it to the maximum amount. Thus, it is intended to provide the heads of institutions with the opportunity to attract the most highly qualified specialists.
Pay fund and wage system for public sector employees
Every year, in accordance with paragraph 28 of the Recommendations, the wage fund is formed based on: •the amount of subsidies provided to federal budgetary institutions to reimburse regulatory costs associated with their provision of public services (performance of work) in accordance with the state assignment, volumes of funds; •volumes of state extra-budgetary funds aimed at reimbursing the costs of institutions for the provision of medical services, and funds received from income-generating activities. The remuneration system must be fixed in collective agreements, agreements, local regulations of institutions (for example, in regulations on remuneration, on incentive and compensation payments, on bonuses for employees, etc.). Also, the listed local acts prescribe the actual amounts of salaries and payments, and the conditions for their provision. In particular, remuneration of workers, according to Art. 129 of the Labor Code of the Russian Federation, includes: •basic (official) salaries; •remuneration for work depending on qualifications, complexity, quantity, quality and conditions of the work performed; •compensation payments (additional payments and bonuses of a compensatory nature, including for work in conditions deviating from normal, work in special climatic conditions and in territories exposed to radioactive contamination, and other payments of a compensatory nature); •incentive payments (additional payments and bonuses of an incentive nature, bonuses and other incentive payments). The Recommendations propose to use basic (municipal) tariff rates, salaries (official salaries), wage rates, which are proposed in the approximate provisions on remuneration of employees of institutions by type of economic activity, approved by state authorities of the constituent entities of the Russian Federation and local governments only as guidelines , without indicating them in the regulations on remuneration of employees of specific organizations. The basic salary (basic official salary), the basic wage rate serve as minimum guarantees for the payment of labor to employees of budgetary institutions.
Basic regulations and principles
In accordance with the Recommendations and Regulations, when developing and changing new remuneration systems, it is necessary to take into account: •Unified tariff and qualification directory of works and professions of workers; •Unified qualification reference book for positions of managers, specialists and employees; •professional qualification groups approved by the federal executive body exercising the functions of developing state policy and legal regulation in the field of labor; •lists of types of compensation and incentive payments; •approximate provisions on remuneration of employees of federal institutions by type of economic activity, approved by federal government bodies and institutions; •opinion of the representative body of workers. The establishment and change of remuneration systems for employees of state and municipal institutions are carried out taking into account: a) the creation of conditions for remuneration of employees depending on the results and quality of work, as well as their interest in the effective functioning of structural divisions and the institution as a whole, in improving the quality of services provided ; b) the achieved level of remuneration; c) ensuring state guarantees for wages; d) increased wages for workers engaged in heavy work, work with harmful and (or) dangerous and other special working conditions, but not lower than the amounts established by labor legislation and other regulatory legal acts containing labor law norms; e) payments for performing overtime work, work at night, weekends and non-working holidays and for performing work in other conditions deviating from normal, but not lower than the amounts established by labor legislation and other regulatory legal acts containing labor law norms; f) the wage fund formed for the calendar year; g) the opinions of the relevant trade unions (associations of trade unions); h) the procedure for certification of employees of state and municipal institutions, established in accordance with the legislation of the Russian Federation; i) standard labor standards for homogeneous work (intersectoral, sectoral and other labor standards, including time standards, production standards, number standards, standard (recommended) staffing standards, service standards and other standards approved in the manner established by the legislation of the Russian Federation). The amounts and conditions for making incentive payments for all categories of employees of institutions are established by collective agreements, agreements, and local regulations on the basis of formalized indicators and performance criteria, measured by qualitative and quantitative indicators.
Remuneration and incentive payments to management personnel
The salaries of heads of budgetary institutions, as well as their deputies and chief accountants, consist of official salaries, compensation and incentive payments.
The amounts and conditions for making incentive payments are established by the founder of a particular budget institution. The official salary of the manager is determined by the employment contract (additional agreement to the employment contract) and is set in an amount not exceeding 5 times the average salary of employees included in the lists of positions and professions of employees of institutions related to the main personnel by type of economic activity. These lists are approved by the relevant federal executive body in agreement with the federal executive body exercising the functions of developing state policy and legal regulation in the field of labor. According to the Regulations, the main personnel of an institution include employees who directly ensure the performance of the main functions for which the institution was created. Such lists by type of economic activity are established by federal government bodies and institutions - the main managers of federal budget funds in agreement with the Ministry of Health and Social Development of Russia. The procedure for calculating the average salary of employees of the main personnel of an institution to determine the amount of the official salary of the head of a federal budgetary institution was approved by Order of the Ministry of Health and Social Development of Russia dated 04/08/2008 No. 167n “On approval of the Procedure for calculating the amount of the average salary to determine the amount of the official salary of the head of a federal budgetary institution.” In accordance with paragraph 5 of the above Procedure, the average monthly number of core personnel working full time is calculated by summing the number of these workers for each calendar day of the month (from the 1st to the 31st, for February - on the 28th e or the 29th), including weekends and non-working holidays, and dividing the resulting amount by the number of calendar days of the month. The number of employees on weekends and non-working holidays is taken to be equal to their number on the working day preceding the weekend or non-working holidays. In this case, only employees who work full time and whom the employer takes into account in the time sheet are taken into account in the calculation. Next, the average number of part-time workers for the reporting month is determined in terms of full employment by dividing the person-days worked by the number of working days in the reporting month according to the calendar. The resulting number of full-time workers is added to the number of part-time workers. The official salaries of deputy heads and chief accountants of institutions are set by the employer at 10-30% lower than the official salaries of the heads of these institutions. Other conditions of remuneration for the specified workers are established by collective agreements and local acts of institutions. Compensatory payments are established for heads of institutions, their deputies and chief accountants as a percentage of official salaries or in absolute amounts, unless otherwise established by federal laws or decrees of the President of the Russian Federation. When establishing incentive payments to the heads of institutions, the main managers of federal budget funds in charge of the institutions have the right to centralize up to 5% of the limits of budget obligations provided for remuneration of employees.
