A certificate of sanitation is an official medical document confirming the health of the patient’s oral cavity. It is drawn up in any form, but must include information about the patient, the conclusion, as well as the signature and seal of the dentist who conducted the examination and treatment.

It will not contain any details about your condition or list of procedures that were performed on you. The doctor will write the main phrase “The oral cavity has been sanitized,” sign and seal it, and the certificate is ready.

How to pay for sick leave using a certificate instead of a certificate of incapacity for work?

The only legal basis for the employer to issue temporary disability benefits is the receipt from the employee of a certificate of incapacity for work, issued in accordance with the current procedure (approved by order of the Ministry of Health dated September 1, 2020 No. 925n).
Any other document, including a certificate issued by a medical institution, cannot be used instead of a sick leave certificate. The legal significance of the certificate can only lie in the fact that it can confirm the employee’s absence from the workplace for a valid reason. Important! Since 2022, the employer will accrue and pay benefits only for the first 3 days of sick leave due to illness or domestic injury. But why can a medical institution issue a certificate instead of a sick leave?

As a rule, such precedents are observed if:

1. An employee fell ill while in another city (for example, on a business trip). Then the medical institution to which he applied may, in certain cases, issue not a sick leave certificate, but a package of documents confirming the fact of the person’s application and the fact of the disease. This, for example, is possible if an employee plans to return before full recovery and register and close sick leave at his place of residence. Then the employee needs to go to his clinic with the documents, where they will issue a sick leave based on them.

2. An employee fell ill while abroad. In this case, he also needs to collect a package of documents confirming his incapacity for work, and, in addition, make a legalized translation of them into Russian. These documents should also be taken to the Russian medical institution where the employee is served, and not to the employer. The sick leave is then transferred to the employer, which will be issued by a Russian medical institution.

3. The employee was injured, but, as the examination showed, it was not serious enough for the doctor to issue a sick leave. This also includes situations when a certificate is issued by a medical service that cannot or cannot always issue a sick leave (for example, an ambulance or emergency room). In practice, the emergency room often sends the person who contacts them under the supervision of a surgeon in the clinic at the place of residence and in this case issues a certificate with a diagnosis and recommendations. And the surgeon at the clinic decides whether to give sick leave or not. Moreover, the sick leave will be from the date of the visit to the clinic, that is, not necessarily the same day as the date of the certificate from the emergency room. Then a certificate from the emergency room can serve as the only evidence that the person did not skip work that day, but visited a doctor due to an injury. It is not possible to pay for disability using a certificate instead of a sick leave certificate. But if the employee has brought a certificate, the employer can still take certain actions.

What to expect during a routine dental visit?

A dental examination is a systematic examination during which the doctor carefully evaluates the condition of the oral cavity and maxillofacial area in order to identify caries, periodontal disease, neoplasms and other diseases.

The stages of the examination include assessing:

  • Facial area and neck. The doctor will perform a thorough palpation to rule out the presence of enlarged lymph nodes or salivary glands, as well as any suspicious growths such as cysts and tumors. The function of the temporomandibular joint is also assessed.
  • Soft tissues of the oral cavity. The tongue, the inner surface of the lips and cheeks, as well as the floor of the mouth and palate are examined. These areas are examined for redness, swelling, damage, and growths. The posterior wall of the pharynx and tonsils are also examined.
  • Periodontal (periodontal tissues). The doctor will evaluate the color, surface (relief), shape of the gingival papillae, as well as signs of inflammation or bleeding of the gums. In addition, the oral cavity is checked for the presence of pathologies such as a decrease in the level of the gingival margin, disruption of the periodontal attachment, the presence of periodontal pockets, migration and mobility of teeth.
  • Conditions of the dentition. The anatomical shape of the teeth, their color and surface, as well as the dental formula are assessed. The bite and occlusal contacts are checked.
  • Dental conditions. The doctor will look for signs of caries, and will also evaluate the condition of existing fillings according to the following criteria: anatomical shape, marginal fit and staining, and the presence of secondary caries. If the patient wears fixed or removable dentures, their current condition and function are checked.

Once the examination is complete, your dentist will discuss the results with you and, if necessary, develop a treatment plan. In addition, the doctor will give recommendations on proper oral care.

The employee provided a certificate instead of sick leave: the employer’s actions

As we noted above, an employee’s provision of a certificate from a medical institution instead of a sick leave certificate may be due to various circumstances. It happens that an employee simply does not have enough experience in clarifying certain nuances of issuing a certificate of incapacity for work. But it is within the power of the employer to help the employee carry out the necessary procedures.

A HR specialist needs:

1. If you have a certificate from a medical institution out of town, ask the employee to come to his local physician and apply for sick leave based on this certificate.

2. If you have a certificate from a foreign medical institution, ask the employee to legalize the document for registration of sick leave under Russian law.

3. When the employee presents a certificate of examination that reveals an injury that does not interfere with work activity, make notes on the work time sheet marked “T” indicating the presence of temporary disability on the corresponding working days without accrual of benefits.

Sick leave will have to be issued retroactively in cases where this is possible. In general, such a procedure is not permitted by law. An exception is if the document is drawn up by a medical commission. The issue of issuing sick leave can be resolved at a scheduled (convened at least once a week) or unscheduled medical commission (clause 14 of the order of the Ministry of Health and Social Development of Russia dated May 5, 2012 No. 502n).

Stages of a full range of events

A full range of treatment and preventive measures consists of the following stages:

  • examination by a dentist;
  • identifying a problem and making diagnostic assumptions about the need to solve it;
  • taking an x-ray of the problem area;
  • ultrasonic cleaning, removal of plaque and tartar;
  • drawing up a plan for further therapy (if necessary);
  • referral for consultations to highly specialized specialists, for example, surgeons or orthodontists (if occlusion disorders and other specific problems are detected);
  • carrying out health procedures;
  • coating of teeth with a special gel polish, which contains calcium and fluoride;
  • providing an opinion from a specialist;
  • drawing up an individual additional schedule of visits (if necessary).

The employee submitted an application for recalculation after providing certificate 182n: actions of the employer

There are certificates, which, in turn, are indispensable when applying for sick leave. Among these is a document drawn up in the form approved in Appendix No. 1 to Order No. 182n of the Ministry of Labor of the Russian Federation dated April 30, 2013.

This document, often referred to as certificate 182n (after the name of the legal act that approves the form of the corresponding certificate), is used to confirm the employee’s income from the previous employer, as well as the number of days the employee was previously on sick leave.

Typically, this certificate is issued by the employer upon dismissal of an employee, along with the work book and other documents, and is presented to the next employer. But it happens that an employee loses this document, or the employer still does not issue it for some reason. As a result, when applying for sick leave from the next employer, the amount of average earnings may be calculated incorrectly or underestimated (due to the lack of certificate 182n as the main document confirming average earnings).

The employee has the power to contact his previous employer and request the relevant certificate again. The obligation of the new employer is to recalculate temporary disability benefits on the basis of this document and the application for recalculation, but only for a period not exceeding 3 years that precede the date of provision of the certificate (Clause 2.1 of Article 15 of the Law “On Social Insurance” dated December 29. 2006 No. 255-FZ).

That is, within 10 days the employer will check the certificate and pay the benefit at the next salary after the verification is completed (Clause 1, Article 15 of Law No. 255-FZ).
